Terms of Use

These Terms & Conditions ("Terms") set out the agreement between ApexLuxe Design Pvt. Ltd., operating under the brand name ApexLuxe ("ApexLuxe", "Company", "we", "us", "our"), and any person who visits our website, requests a quotation, or engages our interior design and execution services ("Customer", "you", "your"). By using our website, submitting an enquiry, accepting a quotation, or engaging us for any project, you agree to be bound by these Terms.

Please read these Terms carefully. If you do not agree with any part of them, we would ask that you do not proceed with booking our services. For project-specific matters, the signed quotation, proposal, or work order issued to you will supplement these Terms and will govern in case of any conflict on that specific matter.

The exact scope of services for your project will be detailed in your quotation or work order. ApexLuxe reserves the right to add, modify, or discontinue any service offering at its discretion.

3. Service Locations

We currently service Delhi NCR, Gurgaon, Noida, Ghaziabad, and Greater Noida, and undertake select projects on a pan-India basis. Availability for a specific pin code or city is confirmed at the time of enquiry, and pan-India projects may carry additional site-visit or logistics charges as communicated in your quotation.

The applicable model, along with corresponding deliverables and responsibilities, will be specified in the quotation or work order for your project.

5. Quotations

ApexLuxe provides quotations to prospective customers free of charge. A quotation is an estimate based on the information, measurements, and requirements available to us at the time it is prepared. Quotations are valid for the period stated on the document (or, where no period is stated, for 15 days from the date of issue) and are subject to revision if project scope, site conditions, or material costs change after acceptance.

6. Payment Terms

Payments for projects taken up on a Design + Execution or Turnkey basis are collected in the following stages, unless otherwise specified in your quotation:

• All prices quoted are inclusive of applicable GST unless stated otherwise in your quotation.
• Payments must be made on or before the due date communicated for each milestone. Delayed payments may attract late payment charges as specified in your quotation or work order, and may result in a corresponding delay in project timelines.
• ApexLuxe reserves the right to pause site work or deliveries until an overdue payment is cleared.
• Accepted payment methods will be shared with you at the time of booking.

7. Cancellation Policy

• Once design work has commenced on your project, the booking cannot be cancelled.
• The booking amount is refundable only if cancellation is requested within 2 days of payment, and before any design or planning work has begun.
• Cancellations made after this 2-day window, or after design work has started, will attract cancellation charges, to cover design hours, material procurement already initiated, and administrative costs. These charges will be communicated to you at the time of cancellation and deducted from any refundable amount.

8. Refund Policy

• No refund is available once execution or design work on your project has started.
• Where a refund is applicable (for example, under the cancellation window described in Section 7), the amount refunded and the timeline for processing will depend on the stage of the project, work already completed, and costs already incurred by ApexLuxe on your behalf.
• Refunds, where approved, will be processed to the original mode of payment within a reasonable time frame, communicated to you on a case-by-case basis.

9. Warranty

• Modular furniture is covered by a warranty against manufacturing defects. The exact warranty period and terms depend on the type of furniture, material, and design chosen for your project, and will be specified in your quotation or invoice.
• Fittings and hardware (such as hinges, channels, locks, and similar components) are covered under the warranty extended by the respective hardware manufacturer, and not by ApexLuxe directly.
• ApexLuxe's warranty does not cover damage caused by misuse, normal wear and tear, unauthorised alterations, improper maintenance, or events beyond our control.

10. Delivery & Project Timelines

The estimated minimum completion time for a project is 45 days from the date of design finalisation and site handover to ApexLuxe. Actual timelines vary based on project scope, site area, site readiness, material availability, and approvals required from you, and will be communicated in your project schedule. Timelines may be affected by factors outside our control, as described in Section 14 (Limitation of Liability).

11. Design Ownership & Intellectual Property

• All design deliverables prepared by ApexLuxe for your project — including 2D drawings, 3D renders, mood boards, interior concepts, and CAD files — remain the intellectual property of ApexLuxe.
• Ownership and usage rights in the finalised designs transfer to you only upon receipt of full and final payment for your project.
• Until full payment is received, ApexLuxe retains all rights to the designs, and you may not use, reproduce, share, or hand over these designs or files to any third party, including any other contractor or designer, for execution.
• Unauthorised use of ApexLuxe's designs prior to full payment may be treated as a breach of these Terms.

12. Photography & Marketing

You agree that ApexLuxe may photograph or film your completed project for use on our website, Instagram, Facebook, portfolio, and other marketing material. If you would prefer your identity or address to remain confidential, we will keep these details out of any public-facing content, and you may inform us of this preference at the start of your project.

13. Third-Party Products, Vendors & Manufacturers

• Where required for your project, ApexLuxe sources products, materials, or fittings from third-party brands, vendors, and manufacturers.
• ApexLuxe's role in relation to such products is limited to coordination — placing orders, arranging delivery, and facilitating installation as part of your project.
• Product warranties, defect claims, and after-sales support for branded or third-party products are the responsibility of the respective brand or manufacturer, and you will need to reach out to their customer support directly for such matters. Where possible, ApexLuxe may assist in facilitating this process, but is not obligated to do so and is not liable for the vendor's response, service quality, or warranty fulfilment.

14. Your Responsibilities as a Customer

To enable us to deliver your project on time and as designed, you agree to:

1. Provide accurate site measurements and information where requested;
2. Allow ApexLuxe and its personnel or associated Apexpreneurs reasonable access to the site as required for design, execution, and inspection;
3. Make payments in accordance with the agreed payment schedule;
4. Review and approve designs, drawings, and material selections promptly, so as to avoid delays;
5. Avoid making unauthorised alterations, or permitting any third party to make alterations, to the work during execution without informing ApexLuxe.

Delays or additional costs arising from your failure to meet the above may affect your project timeline and are not the responsibility of ApexLuxe.

15. Limitation of Liability

ApexLuxe will not be held liable for any delay, failure, or additional cost arising from circumstances beyond our reasonable control, including but not limited to:

• Natural disasters and force majeure events;
• Government restrictions, regulations, or policy changes;
• Delays caused by third-party vendors, manufacturers, or suppliers;
• Shortage or unavailability of materials;
• Delays caused by the customer, including late approvals, late payments, or restricted site access.

To the maximum extent permitted by law, ApexLuxe's total liability in connection with any project shall not exceed the total amount paid by the customer for that project.

16. Website Use & Cookies

Our website is an informational platform that allows you to learn about our services and get in touch with us through a contact form; it does not currently offer user account creation or login functionality.

The website uses cookies and similar tracking technologies, including Google Analytics and Facebook Pixel, to understand site usage and improve our services, along with contact forms, a newsletter sign-up, and WhatsApp chat for communication with our team. By using our website, you consent to the use of these tools. You may control or disable cookies through your browser settings, though this may affect certain website features.

17. Governing Law & Jurisdiction

These Terms are governed by the laws of India. Subject to Section 18 (Dispute Resolution) below, the courts at Noida, Uttar Pradesh shall have exclusive jurisdiction over any disputes arising out of or in connection with these Terms or your engagement with ApexLuxe.

18. Dispute Resolution

In the event of any dispute or disagreement arising out of or in connection with your project or these Terms, both parties agree to first attempt to resolve the matter amicably through mutual discussion and mediation. If the dispute cannot be resolved through mediation within a reasonable period, either party may pursue the matter before the courts at Noida, Uttar Pradesh, as set out in Section 17.

19. Amendments to These Terms

ApexLuxe may update these Terms from time to time to reflect changes in our services, business practices, or applicable law. The updated Terms will be posted on this page with a revised "Last Updated" date. Continued use of our website or services after such changes constitutes your acceptance of the updated Terms. Changes will not apply retrospectively to projects already booked under earlier Terms, except where required by law.
